He was subsequently denied legal aid at critical times in his defence and had a trial before a judge of such bias as would shame a nation with a history of jurisprudence much inferior to that of Scotland. He was then denied leave to appeal. It seems clear that Mr. Green has suffered a miscarriage of justice, that his conviction is unsafe and that his record should be expunged. The following is a letter I wrote to the Scottish Criminal Cases Review Commission on Robert's behalf; it details why he was innocent of any crime. It was rejected by the the Commissioner. Today is a good day for it to be made public. In this regard, the timescale is significant because of the overlapping events and decisions arising from the [UK] Supreme Court ruling in Cadder v. HM Advocate. The Supreme Court ruled in October 2010, and the Scottish Government was forced to bring in emergency legislation to cope with the fallout. The Scotsman reported (20 June 2013) that “By February the following year, almost 900 suspected criminals, including alleged rapists, had walked free, after prosecutors were forced to drop charges against them because of the Cadder ruling. Charges of sexual assault, robbery and possession of firearms were also among 867 dropped in just three months.” Had leave for appeal been granted, the question of Mr. Green’s detention without access to a lawyer in the hours before he was charged on solemn indictment (as it was then) would have been open to examination; for, as the Supreme Court ruled: We the public must remember to keep up all the media activities and the protests until these so called “Gentlemen of Conscience” (who represent we the people) succumb to the pressure!
I am an investigative journalist who has been researching the Alex Salmond case. I am not alone as there are to my knowledge at least three television programmes doing the same thing. I make no claim to be impartial, partially because of my sympathy towards the independence movement and partially because my previous work has dealt substantially with failings in the criminal justice system. As far as the criminal case against Alex Salmond is concerned I will not be able to publish or comment until it is over. However the expenses settlement last week of Alex Salmond’s successful civil action allows me , without any prejudice, to relate just a few the dramatic and deeply troubling things I have already discovered about the civil case.
Mr. Green’s counsel also handed over more than two hundred letters of support from concerned members of the public, many of them professionals. On this week’s show Keelan talks with members of the Hollie Greig Hoax group, including two of Hollie’s alleged abusers, Sylvia Major and Wyn Dragon-Smith, who assert that the whole story is a fabrication. There is not one piece of physical, forensic, eye witness or circumstantial evidence that links either of these two ladies to any abuse of Hollie Greig, yet their names have been plastered all over the Internet and dragged through the mud.

With a view to preventing unnecessary future stress to those who may well have already suffered horrendous historic sexual abuse, and to put an end to further persecution of victims, would you please, in this election year, publish a full list of all those individuals who, for whatever reason, have been granted de facto immunity from prosecution over alleged sexual offences? Turning now to the period between Mr. Green’s arrest and trial, several matters are worthy of note. This first is that while the case was originally a solemn procedure, it was reduced to a summary process by the Aberdeen Procurator Fiscal. This was against the wishes of Mr. Green and was also contrary to his best interests, as determined by his legal advisor, who concluded that no jury would ever convict him on the basis of the evidence presentable in this case. Mr. Green formally complained about this change, as being denied a jury would be to his serious disadvantage. The Hampstead SRA case in North London hit the press in September 2014. The Daily Telegraph called the children’s mother, who had discovered the abuse, “evil” and accused her of “torturing” the claims out of them. Then, the man whom the children clearly accused of abuse — their father — was given an opportunity on the BBC to deny it all, but the BBC failed to point out that the man is a professional actor.
